Thomas and Benjamin, had Cape Neddick land from parents in 1716. Thomas sold to Benjamin before 24 July 1720 d 26 February 1723. Benjamin millwright had York grant 1713/1714 and when +-53 deposition that about 18 years before he went to Damariscotta and built the the first mill there for Mr William Vaughan.

The case was tried at the York Session of the Court of Common Please July 1741. It was a question of title-Indian title-Phillips against Brown. Tappan lost the case; but he carried it up to the Superior Court, which was held at the same place June 1742. William Vaughan then in behalf of the rest, prosecuted, became the sole defendant, as his case would settled all the rest, they having purchased of him. But Tappan was unfprtunate enough to lose his case the second time; and with it his title to Damariscotta Falls, and the lands upon both sides of the Pond and the western and southern side of the Salt Bay.
The property involved in this lawsuit was a "Mesuage, seven cottages, two double sawmills, and one grist mill, with fifty acres of land," whereon these buildings stand. But Vaughan held all he claimed; and many settlers held their lands by deed received from him.
It was a heavy burden for Tappan. He lost his mill site, his property, his casel and the cost of Courts were thrown upon him.

The Upper or Second Parish of York comprised the northwesterly part of the present town, together with most, if not all, of the triangular tract which was set off to South Berwick in 1834. The boundaries were thus set forth in a vote taken at a special town meeting held in York, December 27, 1731:
Voted that the Inhabitants of the Upper End of this Town, viz: Those that do or shall inhabit above, or to the nothwest of the Mill Creek on the Southwest side of York River & on the North-east side of sd River above or to the Northwest of Bass Cove, so a Strait Line from Capt Carnes Grist Mill, to the Middle Point between Baker's Spring & the Marked Trees at the Country Road, in the Bounds between Wells and York. Have hereby granted to them the free Consent of this Town, to be set off, a distinct Parish, if the Honoable General Court shall see meet so to order.
