      In the name of God, Amen. I James Simpson of Rolling Dam in Parish of Dumbarton in County of Charlotte, Farmer, being of sound mind and memory, do make and publish this my last Will and Testament, hence revoking all former last Wills and Testaments by me heretofore made. It is my desire that my funeral and testamentary expenses and all my just debts shall be paid by my Executor hereinafter appointed, out of my estate so soon as may be found convenient after my decease. I give and devise to Harry Havelock Toal, son of James Howard Toal, of Parish of Dumbarton in County of Charlotte, all that certain lot of land with the buildings thereon, situate at Rolling Dam in Parish of Dumbarton in County of Charlotte, bounded on East side by Highway, South and West sides by land of William Martin on North side by land of Estate of William Toal and by the Highway. Containing six acres being the lot and premises whereon I reside. To have and to Hold same to said Harry Havelock Toal, his heirs and assigns forever. It is my will and desire that a promissory note made by James Howard Toal to me for Two Hundred dollars and interest shall be collected and paid to said Harry Havelock Toal where he arrives at the age of twenty one years, provided that is said James Howard Toal shall within one year after my decease, convey to said Harry Havelock Toal, for the consideration of said note, that certain lot of land called the Patrick Scullion Lot, containing fifty acres situate in Parish of Dumbarton, in County of Charlotte, and make execute, and record a good and sufficient Deed thereof, free from all encumbrances, then and in that case, said James Havelock Toal shall be discharged from the payment of said note and the debt for which said note was given.

      I give and bequeath to my nephew James Henry Simpson in reduction of the Mortgage made by him to me One Hundred Dollars.

      I give and bequeath to Gertrude Toal, adopted daughter of William Toal, One Hundred and fifty Dollars.

      I give and bequeath to my brother Abraham Simpson, two hundred dollars.

      I give and bequeath to my niece Margaret wife of Samuel Nixon, ten dollars.

      I give, bequeath and devise to Jane, wife of my brother Jacob Simpson, ten dollars and also all that certain lot of land situate in Parish of Dumbarton, in County of Charlotte, containing forty acres and bounded on North by Estate of Michael McCarroll, on East by Highway, on South by Estate of Samuel McFarlane, being same lot upon which said Jacob Simpson resides. To Have and to Hold same to said Jane, her heirs and assigns forever.

      I give and bequeath to Lilia daughter of James Howard Toal my nephew, one hundred dollars.

      I give and bequeath to Gertrude daughter of James Howard Toal my nephew one hundred dollars.

      I give and bequeath to Margaret wife of James Howard Toal ten dollars.

      I give, devise and bequeath to said Harry Havelock Toal all the rest and residue of my estate to have and to hold same to him, his heirs and assigns forever.

      I nominate and appoint Melbourne MacMonagle of the Town of Saint Stephen, in County of Charlotte, Barrister at Law and Alexander J McCann of the Parish of Dumbarton in said County, Esquire, Executors of this my last Will and Testament. In Testimony whereof I have hereto set my hand and seal this sixteenth day of October in the year of our Lord one thousand eight hundred and ninety.

      I John M Stevens, Registrar of Probate in and for the County of Charlotte, aforesaid, so hereby certify that the foregoing and annexed paper writing contains a true copy of the original Will of James Simpson, late of Dumbarton, in the County of Charlotte aforesaid, Farmer, deceased, which said Will has been duly proved before the Judge of Probate for the said County of Charlotte and is filed in my Office, that I have carefully compared the said foregoing Copy with the original, thereof so filed in my Office as aforesaid and found the same to be a correct and true copy of said Will.
